By using the licketytrip.com web site (“Service”), a service of Zig Internet Solutions, Inc. (“Zig Internet Solutions”), you are agreeing to be bound by the following terms and conditions (“Terms of Service”).

Zig Internet Solutions reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. Notice To All Renters and Advertisers

  1. You represent that You are human and not a “spider”, “bot”, or other automated use of the Service.
  2. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
  3. All vacation rental property-related information is provided by the advertiser (the homeowner or the homeowner's authorized rental agent), who is solely responsible for its accuracy.
  4. LicketyTrip is an advertising service only; Zig Internet Solutions assume no responsibility and in no way warrant the accuracy of the information contained in any of the pages published here.
  5. You are responsible for conducting your own investigation regarding any and all claims made by prospective renters or vacation property owners or agents.
  6. You assume all liability for use of any information you find via the Service.
  7. Zig Internet Solutions is not a licensed real estate broker or agent in any location, and is not licensed to practice real estate in any location.

Notice To Renters

  1. You agree to use the Service for personal use only. The Service must not be used for any reason other than to view or make legitimate inquiries to advertisers regarding your interest in particular vacation rental properties.
  2. You are aware that each advertiser sets its own Refund and Cancellation Policies.
  3. Zig Internet Solutions recommends that you ask for and receive a written notice of the Refund and Cancellation policy from the advertiser.
  4. Zig Internet Solutions is not responsible for the refund of rental fees for any reason.
  5. Confirmation of information published via the Service is your sole responsibility, as the renting party.
  6. The Service does not set rates. The Service's advertisers do and they can change at any time.

Notice To Advertisers

RENTERS
  1. Zig Internet Solution is not responsible for any action, or omission of action, by any renter obtained by the use of the Service.
  2. Qualification of all renters is the sole responsibility of the advertiser.
ACCURACY
  1. You are solely responsible for keeping your property information up to date in the Service, including, but not limited to any and all representations about the property, its amenities, location, and its availability for a specific date or range of dates. Zig Internet Solutions makes no representation or warranties that any of the copy or availability information published in the Service is accurate or up-to-date even in the case where visitors have searched for specific special offers, dates, or types of properties.
  2. By accepting these Terms of Service and listing with the Service, you agree to indemnify and hold Zig Internet Solutions and its affiliates harmless against all costs, expenses and losses arising out of a claim relating to the content of an advertisement.
LAYOUT AND COPY
  1. Zig Internet Solutions reserves the right to determine the final design, layout and functionality of the Service. This is subject to change from time to time without notice.
  2. In order to create a uniform environment for our visitors, Zig Internet Solutions reserves the right to edit copy or amend the layouts of images supplied for the Service.
  3. Zig Internet Solutions reserves the right, at its discretion, to amend and edit copy entered into the Service by you. All copy edits submitted by you are subject to review and approval of Zig Internet Solutions in its sole opinion.
  4. Notwithstanding its right to edit and amend copy and photographs, Zig Internet Solutions accepts and holds no liability for any loss or damage resulting from the design or positioning of the properties or changes made to the photographs and copy submitted by you or edited by Zig Internet Solutions staff.
PHOTOGRAPHS

By submitting a photograph to the Service, you are warranting that...

  1. You hold all intellectual property rights for each submitted photograph, or
  2. You have secured from the copyright holder all rights necessary for the photograph to be used in an online advertisement, and
  3. Any people in the photograph have given permission for their likeness to appear in an online advertisement, and
  4. The photograph accurately and represents the subject of the photograph and has not been altered in a manner that would mislead a viewer of that photograph, and
  5. You will indemnify and hold harmless Zig Internet Solutions from any cause of action arising from any misrepresentation with respect to any and all the photographs so submitted.
LIABILITY
  1. Zig Internet Solutions does not warrant that the operation of the Service will be uninterrupted or error-free.
  2. Zig Internet Solutions will not be liable to the advertiser for any special, consequential, incidental or indirect damages, including lost profits, resulting from service interruption.
COPYRIGHT

By accepting these Terms of Service and posting a listing with the Service, you grant Zig Internet Solutions a fully paid up license to use the copy and the photographs on its website and grant Zig Internet Solutions the ability to copyright and protect the images, copy, and information available via your listing from unauthorized use by unaffiliated third parties. Zig Internet Solutions is not responsible for any infringement of copyright laws resulting from material supplied by you and you indemnify Zig Internet Solutions against any action brought for breach of copyright or other rights from the use of such material you supplied.

ONE PROPERTY PER LISTING
  1. Each advertisement on the Service website displays an individual and uniquely identified property available for short term vacation rental.
  2. Only one property/rental unit can appear on each listing.
  3. Zig Internet Solutions reserves the right to amend the copy or remove the advertisement, when these terms have been violated.
TERMINATION OF LISTING
  1. Zig Internet Solutions reserves the right to refuse any listing submitted to the Service. We can refuse to publish the ad for no reason, and you specifically agree to hold us harmless for any loss or liability that may arise from such a decision.
  2. If you submit unsuitable material into the Service, or persistently misuse the Service, Zig Internet Solutions reserves the right to remove the property from the Service website.
  3. If Zig Internet Solutions receives a complaint from a person who has rented an advertisers property which Zig Internet Solutions considers to be justified, or if you double-book a property for multiple renters on the same date, or if you engage in any business practice that would be considered within the vacation rental industry to be unfair, or if you are in breach of your obligations to Zig Internet Solutions, then Zig Internet Solutions reserves the right to remove the property from the Service without notice.

Email Policies

Zig Internet Solutions forbids the abuse of the Service' email or inquiry system to send any unsolicited commercial email (commonly known as SPAM) to any Service advertiser. Zig Internet Solutions reserves the right to identify and control such abuse in any way that it considers to be reasonable. Zig Internet Solutions also reserves the right to cancel any member that mentions Zig Internet Solutions, the Service, or any of its associated websites, URLs, or any associated Zig Internet Solutions email address in any SPAM email message or Usenet posting.

Zig Internet Solutions is the sole judge in determining what constitutes SPAM.

It is the goal of Zig Internet Solutions to reduce the volume of SPAM delivered via the Service's email or inquiry systems. To achieve that goal, inquiries and email may be monitored and filtered by Zig Internet Solutions prior to delivery to Zig Internet Solutions advertisers. Inquiries may be read by Zig Internet Solutions staff advertisers. Despite Zig Internet Solutions' filtering efforts, it is likely that some SPAM inquiries and email will be delivered anyway. It is also possible that some non-SPAM inquiries may be be not be delivered as a result of Zig Internet Solutions filtering efforts.

Inquiries are delivered via Internet email and are not to be considered private. Internet email delivery is not 100% reliable and Zig Internet Solutions cannot be held responsible for undelivered inquiries or for missed income as a result of undelivered inquiries.

Zig Internet Solutions, at its own discretion, may supply to potential renters the direct email address of Zig Internet Solutions advertisers for the purpose of making a rental inquiry, or for filing a complaint.

Limitation of Liability

IN NO EVENT SHALL ZIG INTERNET SOLUTIONS OR ITS ADVERTISERS BE LIABLE FOR ANY SPECIAL, INDIRECT, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, BUSINESS, DATA OR PROFITS, LITIGATION AND THE LIKE, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THIS AGREEMENT AND THE SITE WOULD NOT BE PROVIDED TO YOU ABSENT SUCH LIMITATIONS. SOME STATE STATUTES MIGHT APPLY REGARDING LIMITATION OF LIABILITY.

Release

You agree to indemnify, defend and hold harmless Zig Internet Solutions, its affiliates and advertisers from any liability, loss, claim and expense (including attorneys' reasonable fees) related to (i) your violation of this agreement, and (ii) your use of the Service.

General Terms

These Terms of Service shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to the choice of law provisions thereof. Any dispute or claim arising out of, or in connection with, these Terms of Service shall be finally settled by binding arbitration in Greensboro, North Carolina, in accordance with N.C. Gen. Stat. § 1-567.1 et seq. (the "Uniform Arbitration Act") and the then-current rules and procedures of the American Arbitration Association by one (1) arbitrator appointed by the American Arbitration Association. The arbitrator shall apply the law of the State of North Carolina, without reference to rules of conflict of law or statutory rules of arbitration, to the merits of any dispute or claim. Judgment on the award rendered by the arbitrator may be confirmed, reduced to judgment and entered in any court of competent jurisdiction. The parties agree that, any provision of applicable law notwithstanding, they will not request, and the arbitrator shall have no authority to award, punitive or exemplary damages against any party. In the event that any arbitration, action or proceeding is brought in connection with these Terms of Service, the prevailing party shall be entitled to recover its costs and reasonable attorneys' fees.

These Terms of Service and the rights granted hereunder may not be assigned or transferred by You, in whole or in part. Without limiting the foregoing, You may not provide any other person access to the Service. If any provision of these Terms of Service is held invalid, such invalidity shall not affect any other provisions of these Terms of Service. Headings are inserted for reference only and shall not be construed as a part of these Terms of Service. No failure or delay on the part of Zig Internet Solutions to exercise any right under these Terms of Service will operate as a waiver thereof, nor will any single or partial exercise of any right preclude any other or further exercise thereof or of any other right. These Terms of Service represents the entire understanding and agreement between You and Zig Internet Solutions concerning Your Use of the Service, and supersedes any prior representations, understandings or agreements.

By using this website or services provided by Zig Internet Solutions, You agree to all of the terms and conditions contained in these Terms of Service.
